Federal officials plan to round up and remove 67 wild horses living in the Fish Springs and Dayton areas.

The horses are living outside the Pine Nut Herd Management Area, and Bureau of Land Management officials say they are posing a public safety hazard on roads and damaging private property. At least seven wild horses were reported killed in vehicle accidents in February and March of this year, according to the BLM.

“The 67 excess horses residing outside the management area have been a problem for some private land owners, as well as posing a public safety hazard on public roads,” according to the report. “If the 67 wild horses were captured and released back into the management area, they will simply return to their home range off the area.”

The bureau is seeking public comment on the plan to round up most of the horses living in the Pine Nut area, treat the mares with a fertility control drug and release them back into the area.

The Pine Nuts are home to more than 210 horses with a third living outside the management area.

The horses removed will be put up for adoption through the wild horse and burro program or placed in long-term holding pastures, according to the BLM.

A draft environmental impact statement has been conducted on the plan to gather the horses, give 45 mares a two-year fertility control vaccine and then release all the horses back into the area.

According to the bureau, the impact statement affects horses in the Pine Nut, Clan Alpine and Pilot Mountain areas. In all 1,111 horses will be rounded up between the Western Nevada areas.

A total of 224 horses will be removed, 171 of which actually live outside the areas. Most of them congregate along Highway 95 near Walker Lake.

The Washoe County Health District says chickens in Lemmon Valley have
tested positive for western equine encephalitis.

Authorities say chickens are good test subjects because they have
immunity, but will test positive for the virus. "What we do is, every
2 weeks or so, we come out and we take blood samples and that way we
can tell if mosquitoes have bitten the chickens and given them the
viruses," says Tracie Douglas. Health officials say the western
equine encephalitis is a rare disease in humans, but still anyone can get it.

Some people maybe more at risk than others including those living in
or visiting an area that has infected mosquitoes.

Western equine encephalitis inflames the brain and spinal column. The
disease is fatal to about 3 percent of people who develop severe
symptoms. While there is no specific treatment for the disease,
health officials say the best thing to do is to avoid mosquitoes all together.

If you have to be outside, make sure to take precautions. "Use
repellents. It's so easy to do; read the bottle. If you have to
reapply it every couple of hours, do so. You don't have to use
something that has a real high content of repellent. You can use
products with DEET or lemon or eucalyptus oil."

Health officials say the virus affects more horses. "Most people
don't get, that is, it very rarely it attacks humans. But, it does
attack horses a lot," Douglas says.

And it's not just the encephalitis, but West Nile to worry about.
That's why they're urging horse owners to get their equines
vaccinated. "Horses are very sensitive to these viruses and so it can
kill them," she says.

[Western equine encephalitis virus, a member of the family
_Togaviridae_, genus _Alphavirus_, is closely related to eastern and
Venezuelan equine encephalitis viruses.

Infection can cause a range of illnesses in people, from no symptoms
to fatal disease. People with mild illness often have only a headache
and sometimes fever. People with more severe disease can have sudden
high fever, headache, drowsiness, irritability, nausea, and vomiting,
followed by confusion, weakness, and coma. Young infants often suffer seizures.

Western equine encephalitis is a disease that is spread to horses and
humans by infected mosquitoes. It is one of a group of mosquito-borne
virus diseases that can affect the central nervous system and cause
severe complications and even death. Other similar diseases are
eastern equine encephalitis, St Louis encephalitis, and LaCrosse encephalitis.

The virus that causes western equine encephalitis has a complex life
cycle involving birds and a specific type of mosquito, _Culex
tarsalis_, which is common in farming areas and around irrigated
fields. Humans, horses, and other mammals are not an important part
of the life cycle of the virus.

Western equine encephalitis is found in North, Central, and South
America, but most cases have been reported from the plains regions of
the western and central United States.

Western equine encephalitis was first isolated in the United States
in 1930. In 1941, a US epidemic involved 300 000 horses and 3340
humans. Since then, occasional smaller epidemics have occurred. The
risk of exposure has been increasing in recent years as people move
into previously undeveloped areas where the virus lives. Expansion of
irrigated agriculture in the North Platte River Valley (Colorado,
Wyoming, and Nebraska) during the past several decades has created
habitats and conditions that favor increases in the number of
grain-eating birds and mosquitoes that spread western equine encephalitis.

The western equine encephalomyelitis (WEE) virus group includes the
western equine encephalitis (WEE), Sindbis, Ft Morgan, Aura, and Y
61-33 viruses. The western equine encephalitis virus can cause
disease in humans, horses, and some species of birds. A related
virus, the Highlands J virus, is sometimes isolated in the eastern
United States. The Highlands J virus can cause disease in turkeys. It
has also been linked to a single case of encephalitis in a horse.

Eastern and western equine encephalomyelitis are very similar in
horses. The initial clinical signs are usually fever, anorexia, and
depression. In severe cases, this prodromal stage is followed by
neurologic signs; the symptoms may include involuntary muscle
movements, impaired vision, aimless wandering, head pressing,
circling, an inability to swallow, ataxia, paresis, paralysis, and
convulsions. Periods of excitement or intense pruritus can also be
seen. Laterally recumbent animals may develop a characteristic
"paddling" motion. Both EEE and WEE can also cause asymptomatic
infections or mild disease without neurologic signs. Occasional cases
of encephalitis have been seen in pigs.

Harry Reid and the Culture of Corruption

Old but Important News

Once again, we discover why the Democrats quietly dropped their "culture of corruption" theme for the upcoming midterms. The AP catches Harry Reid without a disclosure on real-estate deals that netted him $700,000 in profit:


Senate Democratic Leader Harry Reid collected a $1.1 million windfall on a Las Vegas land sale even though he hadn't personally owned the property for three years, property deeds show.

In the process, Reid did not disclose to Congress an earlier sale in which he transferred his land to a company created by a friend and took a financial stake in that company, according to records and interviews.

The Nevada Democrat's deal was engineered by Jay Brown, a longtime friend and former casino lawyer whose name surfaced in a major political bribery trial this summer and in other prior organized crime investigations. He's never been charged with wrongdoing - except for a 1981 federal securities complaint that was settled out of court. ...

The deal began in 1998 when Reid bought undeveloped residential property on Las Vegas' booming outskirts for about $400,000. Reid bought one lot outright, and a second parcel jointly with Brown. One of the sellers was a developer who was benefiting from a government land swap that Reid supported. The seller never talked to Reid.

In 2001, Reid sold the land for the same price to a limited liability corporation created by Brown. The senator didn't disclose the sale on his annual public ethics report or tell Congress he had any stake in Brown's company. He continued to report to Congress that he personally owned the land.

After getting local officials to rezone the property for a shopping center, Brown's company sold the land in 2004 to other developers and Reid took $1.1 million of the proceeds, nearly tripling the senator's investment. Reid reported it to Congress as a personal land sale.


In fact, this isn't a new development for Harry Reid. Less than two months ago, I wrote about Reid's questionable involvement and compensation in a related real-estate deal outside of Las Vegas, and the post turned into a column for the New York Post. Harvey Whittemore, a lobbyist and real-estate investor, plied Reid with campaign contributions and employed Reid's family members -- and in exchange, Reid did a number of favors that allowed Whittemore to realize large profits at the expense of environmental regulations that Reid helped Whittemore bulldoze. I wrote at the time:



The story of Coyote Springs sounds like a Horatio Alger story. The land Whittemore bought in 1998 from a defense contractor who intended on using it for target practice had a number of restrictions on its use. A quarter of it was subject to a federal power-line right of way. Another quarter had federal protection for the desert tortoise, an endangered species that also is Nevada's official state reptile. The land had a fragile series of streams and washes that required special permission on which to build without ruining the desert's ecosystem.

None of these obstacles proved too difficult for Whittemore, at least not while he had his friend Harry Reid running interference in Congress. Interior refused to relocate the tortoises for over five years, until the Bureau of Land Management agreed to swap the land for another parcel abutting a federal preserve elsewhere. No one ever did an analysis to determine whether the deal was fair to either party, nor did the BLM go to Congress for approval on the changes to a project that Congress had explicitly legislated.

In 2002, Reid worked on the power corridor. He inserted obscure provisions into a land management bill that relocated the power corridor, freeing Whittemore to build on the 10,500 acres that Congress had previously held -- which means that someone else now had to lose property value for Whittemore's benefit, and for no cost whatsoever. That bald move caused raised eyebrows at the BLM and the Senate's Energy and Natural Resources Committee, and Reid backed away -- for the moment. Less than two years later, Reid tried again to give Whittemore the land for a song ($160,000), but Congress balked again. He finally settled for freeing the land for development and allowing Whittemore to buy it at a fair market rate, and forcing the government to relocate the power corridor.

In 2005, Reid and fellow Nevada Senator John Ensign conducted a series of interventions with the EPA to eliminate the final obstacle -- the environmental impact on the fragile ecosystem in Coyote Springs Valley. When the agency blocked Whittemore's efforts, Reid and Ensign held several meetings with EPA officials to pressure them into submission. Whittemore used another Reid son, Lief, to lobby his father's office for assistance. In the end, the pressure paid off, as the EPA backed down from its opposition after winning a few concessions on the development plan.

What did Reid get in exchange for all of this support? According to the Times, Whittemore contributed $45,000 to Reid and his PACs since 2000. He also gave the DSCC $20,000 in 2000, when it pushed Reid as a leader for the party in the Senate. Reid's son Josh got $5,000 for his unsuccessful campaign for a city council seat; his other sone Rory got $5,000 for his successful effort to win a spot on the Clark County Board of Commissioners.


This appears to be of a piece with the Whittemore connection. In fact, it seems as though Whittemore's project was part of the transactions the AP discovered. "One of the sellers was a developer who was benefiting from a government land swap that Reid supported" -- that's the same project as Coyote Springs. A major portion of that story had to do with Reid trying to grease the skids for the land swap so that Whittemore could get around the federal right-of-way.

Hilariously, this appears just days after James Webb tried smearing George Allen with a pseudoscandal over stock options that Allen disclosed and never exercised, meaning that he never cleared a dime from the options. Now we have the Democratic caucus leader dodging disclosures and failing to disclose $800,000 in profits from a project on which he partnered with a lawyer suspected of connections to organized crime and a bribery scandal. And let's not forget Reid's connections to Jack Abramoff, whom Democrats tried mightily to use as a poster boy for Republican-only graft:


The activities _ detailed in billing records and correspondence obtained by The Associated Press _ are far more extensive than previously disclosed. They occurred over three years as Reid collected nearly $68,000 in donations from Abramoff's firm, lobbying partners and clients. ...

Abramoff's records show his lobbying partners billed for nearly two dozen phone contacts or meetings with Reid's office in 2001 alone.

Most were to discuss Democratic legislation that would have applied the U.S. minimum wage to the Northern Mariana Islands, a U.S. territory and Abramoff client, but would have given the islands a temporary break on the wage rate, the billing records show.

Reid also intervened on government matters at least five times in ways helpful to Abramoff's tribal clients, once opposing legislation on the Senate floor and four times sending letters pressing the Bush administration on tribal issues. Reid collected donations around the time of each action.


Reid also had a former staffer go to work for Abramoff, who then held campaign fundraisers in Abramoff's offices.

No wonder Reid hung up on the AP reporter when they asked him to comment on this story. Reid has demonstrated that he has few scruples when it comes to using his position and power for his personal enrichment and that of his family and "associates". If the Democrats continue to have Reid as the leader of their Senate caucus, voters should realize the kind of leadership he will provide if the Democrats win control of the Senate.

UPDATE: This story provides an answer to a question I had regarding Reid's dealings with Whittemore. The earlier story showed that Whittemore benefited Reid's kids and his election campaigns, but Reid worked awfully hard for Whittemore's benefit for no direct personal payoff. This land-swap deal and the $700,000 profit shows that Reid had a direct financial interest for his earlier interventions on Whittemore's behalf.

Here Pat Irwin, District Manager of the USFS Humboldt-Toiyabe Nat'l Forest, talks about the 1995 rider to the Recission Act that requires the USFS to complete environmental analysis of all grazing areas on all national forest lands. In lieu of the completion of the EA's, he states, "grazing is permitted BUT ONLY UNDER THE PREVIOUS TERMS AND CONDITIONS." Does this mean they cant INCREASE the # of cattle allowed to graze or of the lands available to them? Does this mean that they cannot modify the number of wild horses (and burros) allowed to graze in these areas? Also of note is the fact that the EA requirements for grazing lands set out in the 1995 rider to the Recission Act have to this day not fully complied with, as you will see, only two EAs for two USFS areas have been completed so far, and it has been how many years?

Welfare Ranchers In Arrears and Another FOIA Request

Dear Sir,
I am writing pursuant to the FOIA law in hopes that you will provide me with a list of all the public land ranchers who are in arrears and/or late and/or not paying their public land grazing fees.

I understand from my research on this subject that there are many of such kind, so what I am seeking to acertain is the true and exact numbers as well as their names and how much each individual one was owing the govt.

(Or some such thing. This is a works in progress just an idea for now but will get this one out soon also.)

Legislative Proposals to Change Terms of Heil Trust / Commission

Not having researched the legislative history of this commission, I am left to assume (for now) that such revisions were proposed and eventually passed)


Here is an excerpt from that article where a RANCHER is sticking up for the wild ones and objects to these (proposed) legislative changes to the Act that created Nevadas Commission for the Preservation of Wild Horses;

"...The (proposal) measure also requires the commission to "encourage cooperative efforts and to participate in programs for the removal and disposal of wild horses.''

Steven Fulstone, a Smith Valley rancher and vice-chairman of the Nevada wild horse panel, says the wording is certain to provoke legislative battles.

"That one I just can't agree with,'' Fulstone said. "That's against the wild horse and burro act. It's not appropriate for a commission for the preservation of horses to do that.
"There has to be a reasonable way to handle the overpopulation of wild horses. Those changes in the legislation are not the way to do it.''

The Recission Act of 1995

Not sure but I think this law also applies to BLM lands. This law concerns NEPA which require that Environmental Accessments be written prior to the renewal of grazing permits. However, this law exempts NEPA requirements for issuing of grazing permits under certain conditions....but if I am reading it right, NEPA filings are still required to be done at some point in time "in the future" and if required, changes to the grazing permits may be called for. I am wondering how many NEPA filings were actually EVER compiled in reguards to ANY grazing permit areas? Hummm, another something to look into, I would think..

If you read the stated goals of the "Commission," (formed with Leo Heils Will Money) Its main purpose was to "create sanctuaries" for Nevadas wild horses and to "preserve and protect them" and all I wanna know is what did the Commission ever do in furtherance of these goals? Moreover, the few remaining "pennies" they have left of Heils Trust (what was supposed to be a perpetual) trust,.....they plan on giving to the Mustang Prison Training Program, which does NOTHING to keep the wild horses free and "preserved " and/or "protected" upon their lands; See minutes; http://www.dcnr.nv.gov/wp-content/uploads/2010/07/min_062510.pdf
